The U.S. employer or agent must file Form I-129, Petition for a Nonimmigrant Worker, with U.S. Citizenship and Immigration Services (USCIS) including all required O1 documents.
Once the petition is filed, USCIS reviews the application and the applicant's qualifications and the nature of the work to be done in the U.S are evaluated.
Outside the United States, the applicant must apply for the O1 visa at a U.S. embassy or consulate with Form DS-160. For the applicant currently in the U.S., apply for a change of status with Form I-539.
Once the visa application is approved, the applicant will receive an O1 visa in their passport, allowing them to travel to the United States.
